1. Definitions
Unless otherwise stated, capitalised terms used in this Privacy Policy have the same meaning given to them in the applicable BakX Driver Services Agreement or User Terms of Use.
- Application means the BakX Driver Application and/or BakX User Application.
- Governmental Authority means any government, regulatory body, court, authority, agency, board, commission, or similar body.
- Personal Information means information about an identifiable individual, whether true or not, including names, contact details, location data, images, payment-related details, identification data, vehicle information, biometric data, and other information that can identify a person.
2. Personal information we collect
We may collect personal information directly from you, automatically when you use BakX, or from third parties who provide services to us or work with us.
Information you provide
When you register or use BakX, you may provide information such as your name, account ID, email address, phone number, account details, booking details, pickup and drop-off locations, delivery requirements, messages, images, and support enquiries.
If you register as a driver or delivery service provider, we may collect additional onboarding information such as vehicle details, licences, approvals, insurance details, bank account details, verification information, biometric information, and identity information where required or allowed by law.
Payment-related information
Where electronic payment is used, we may collect payment-related information such as the payment method, card issuer, account holder name, card-related details, payment amount, transaction status, and related payment records.
Technical and website information
When you use the application or visit the website, we may collect technical information such as IP address, pages viewed, session duration, device identifiers, advertising IDs, device model, manufacturer, operating system, browser information, and usage activity.
Cookies
BakX may use cookies and similar technologies to improve the user interface, track activity, understand usage, and improve the platform experience. You may disable or delete cookies using your browser or device settings, but some website or app functionality may be affected.
Images and media
If you allow BakX to access your camera, gallery, or file storage, we may collect and store images or media that you choose to upload or share through the application.
Third-party information
We may collect information from agents, vendors, suppliers, contractors, partners, service providers, verification providers, and other third parties where needed for the services, compliance, verification, safety, product development, support, or business operations.
If you provide us with information about another person, such as a family member, customer, spouse, friend, or contact person, you confirm that you have obtained their consent to do so.
Identification numbers
BakX does not generally collect South African ID numbers from normal users for ordinary use of the application. For drivers and delivery service providers, BakX may collect, use, and disclose South African ID numbers, foreign identification numbers, or similar information where required for verification, legal compliance, fraud prevention, safety, or investigations.
3. Location data
Location data is important to the BakX platform because it helps with pickup and drop-off details, nearby provider matching, route visibility, trip progress, and delivery management.
- Users may be asked to provide pickup and drop-off locations and may allow foreground location access.
- Drivers may provide real-time location information while available, signed in, accepting work, or completing trips.
- Driver location may be collected when the driver app is open and, where enabled, when it is running in the background.
- You may disable location permissions on your device, but doing so may limit important BakX features.
4. How we use personal information
BakX may use personal information where reasonably necessary for the services, platform operations, safety, support, compliance, analytics, marketing, and business improvement.
For users
- Register, identify, authenticate, verify, and manage your account.
- Enable drivers or delivery service providers to provide the requested services.
- Process bookings, orders, requests, payment transactions, receipts, and service updates.
- Communicate with you about your account, bookings, platform updates, enquiries, and support requests.
- Improve, test, maintain, personalise, and develop the BakX application and website.
- Analyse activity, usage trends, service demand, and platform performance.
- Send direct marketing communications, promotions, and special offers where permitted.
For drivers and delivery service providers
- Register, identify, authenticate, verify, and manage your driver/provider account.
- Carry out identity, vehicle, eligibility, onboarding, compliance, or fraud-prevention checks.
- Enable you to receive, accept, manage, and complete delivery service requests.
- Process payment-related information and operational records connected to completed services.
- Relay user orders, request details, account notices, service changes, and support communication.
- Monitor responsiveness, service activity, safety feedback, performance, usage trends, and platform quality.
- Send marketing, product updates, promotions, or service opportunities where permitted.
General business and legal purposes
- Operate, administer, support, secure, and improve BakX.
- Resolve technical, operational, payment, booking, or support issues.
- Generate statistics, analytics, research, testing, and product development insights.
- Prevent, detect, investigate, and respond to fraud, illegal activity, misuse, safety incidents, or unauthorised access.
- Support audits, due diligence, business restructuring, mergers, acquisitions, or asset transfers.
- Comply with laws, regulations, reporting duties, investigations, court processes, and government requests.
5. Sharing personal information
BakX may share personal information where reasonably necessary to provide the platform, complete delivery services, support users and providers, comply with law, or protect our legitimate interests.
- With drivers or delivery service providers so they can provide requested services to users.
- With users so they can request, receive, track, or communicate about services from providers.
- With verification, payment, cloud hosting, analytics, support, marketing, operations, and technology providers.
- With affiliates who assist BakX with data processing, business operations, platform delivery, or marketing where permitted.
- With government, regulatory, law enforcement, or court authorities where required or authorised by law.
- Where necessary for legal proceedings, fraud investigations, public safety, health emergencies, or compliance duties.
- In connection with a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction.
Where possible and appropriate, BakX will use reasonable efforts to limit the information shared and remove details that directly identify you when identification is not necessary.
6. Cross-border transfers
Your personal information may be transferred to, stored in, or processed in a country other than the country where you live or use BakX. This may happen where BakX, its servers, affiliates, partners, suppliers, or service providers operate in another jurisdiction.
Where personal information is transferred or processed outside your country, BakX will use reasonable efforts to ensure that appropriate data protection standards apply in line with this Privacy Policy and applicable law.
7. Retention of personal information
BakX keeps personal information only for as long as reasonably necessary for the purpose for which it was collected, or for as long as required or authorised by law, business operations, dispute resolution, safety, fraud prevention, tax, audit, compliance, or contractual purposes.
When information is no longer needed, BakX will take reasonable steps to delete it, anonymise it, or remove the means by which it can be associated with you, unless retention is still legally or operationally required.
Some information shared with other users, drivers, providers, authorities, or third parties may be retained by those parties according to their own policies or through means outside BakX’s control, such as screenshots, phone messages, or external communication records.
8. Access and correction
You may request access to or correction of personal information that BakX holds about you by contacting us using the details at the end of this policy. Subject to applicable law, BakX may charge a reasonable administrative fee for such requests.
BakX may refuse a request where permitted or required by law, including where the request is trivial, frivolous, vexatious, impractical, unlawful, or would reveal personal information about another person.
9. Storage and security
Personal information collected by BakX may be stored, transferred, or processed by BakX, affiliates, contractors, suppliers, or third-party service providers. BakX uses reasonable efforts to require service providers to maintain protection comparable to the commitments in this Privacy Policy.
BakX takes reasonable steps to protect personal information from unauthorised access, collection, use, disclosure, unlawful processing, accidental loss, destruction, or damage. However, internet and electronic transmission is never completely secure, and BakX cannot guarantee that information transmitted online will never be intercepted, accessed, altered, destroyed, or disclosed by unauthorised third parties.
10. Changes to this Privacy Policy
BakX may review and update this Privacy Policy from time to time to reflect business, platform, legal, technical, or regulatory changes. We may notify you through the application, website, account notice, email, or other reasonable means.
Your continued use of BakX after changes are published means that you accept the updated Privacy Policy. The English version will prevail if there is any inconsistency between translated versions.
11. Acknowledgement, consent, and withdrawal
By accepting this Privacy Policy or using BakX, you acknowledge that you have read, understood, and accepted this policy. You consent to BakX collecting, using, disclosing, storing, transferring, and processing your personal information in accordance with this policy.
If you provide personal information about another person, you confirm that you have obtained that person’s consent for BakX to collect, use, disclose, store, transfer, and process their information as described in this policy.
You may withdraw consent for some or all collection, use, or disclosure of your personal information by giving BakX reasonable written notice. Depending on the consent withdrawn, certain BakX features may stop working, and your account or contractual relationship with BakX may need to be restricted or terminated. Existing rights and obligations will remain reserved.
12. Marketing and promotional material
BakX may send marketing or promotional communications through email, SMS, phone calls, online messaging, push notifications, or other channels where you have subscribed, opted in, or where such communication is permitted by law.
Marketing may include special offers, promotions, events, product updates, partner offers, service updates, and platform news. BakX may also use vehicle images provided by drivers or service providers for platform illustration and marketing purposes where permitted.
You may opt out of marketing at any time by using the unsubscribe link in a message or by contacting BakX. Even after opting out, BakX may still send non-promotional messages such as receipts, account notices, security alerts, booking updates, or service communications.
13. Anonymised data
BakX may create, use, disclose, or license anonymised or aggregated data where identifiers have been removed so that the data cannot reasonably be linked back to an identifiable person, either alone or when combined with other available data.
14. Third-party platforms
The BakX website, application, or marketing material may contain links to third-party websites, plug-ins, applications, advertisements, or platforms. These third parties may collect and process your personal information according to their own policies.
BakX does not control and is not responsible for third-party platforms, their privacy practices, their terms, their content, or the information they collect when you interact with them. You should review their privacy policies before submitting information to them.
